NOIR Collective LTD. ("NOIR," "we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, share, and protect your personal information when you use the NOIR application ("Service").

1. Information We Collect

Information You Provide

Account information: name, email address, password, age, gender.
Profile information: photos, bio, title, industry, and headline.
Application information: admission path, social media handles, LinkedIn URL, portfolio URL.
Communications: messages sent to other members, reports, support requests.
Payment information: processed by the Apple App Store (we do not directly collect or store payment card details).

Information Collected Automatically

Device information: device type, operating system, unique device identifiers.
Usage data: features used, pages viewed, actions taken, timestamps.
Location data: with your explicit permission, approximate GPS coordinates to show nearby members and events.
Push notification tokens: to deliver notifications to your device.

2. How We Use Your Information

We use the information we collect to:

Provide, maintain, and improve the Service.
Create and manage your account and profile.
Match you with other members based on your preferences.
Display your profile to other members (subject to your visibility settings).
Show nearby members and events based on your location.
Process subscription payments and manage membership tiers.
Send push notifications about matches, messages, and app updates (subject to your notification preferences).
Review membership applications.
Enforce our Terms of Service and Community Guidelines.
Respond to your requests and support inquiries.
Detect and prevent fraud, abuse, and security threats.

3. Location Data

We collect your location only with your explicit permission via your device's location services. Location data is used to show nearby members and events. Your exact coordinates are never displayed to other members — only an approximate city-level location (e.g., "New York, NY") is shown on your profile. You can revoke location permissions at any time through your device settings.

4. Data Sharing

We do not sell, rent, or trade your personal information to third parties. We share your data only in the following circumstances:

With other members: Your profile information (name, age, photos, bio, location) is visible to other NOIR members, subject to your visibility settings.
Service providers: We use trusted third-party services to operate the platform:
- Supabase (database, authentication, file storage)
- RevenueCat (subscription payment management)
- Expo (push notifications)
- Google (OAuth authentication)
- Apple (OAuth authentication)
Legal requirements: We may disclose your information when required by law, subpoena, or legal process, or when we believe disclosure is necessary to protect our rights, your safety, or the safety of others.
Business transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred as part of the transaction.

5. Data Security

We implement industry-standard security measures to protect your personal information, including:

Encrypted data transmission (TLS/SSL).
Secure password hashing.
Row-level security policies on our database.
Access controls limiting who can view and process your data.

However, no method of transmission over the Internet or electronic storage is 100% secure. We cannot guarantee absolute security of your data.

6. Data Retention

We retain your personal information for as long as your account is active or as needed to provide the Service. If you delete your account through Settings, we will permanently delete your profile data, including photos, messages, matches, and application information. Some data may be retained in backups for a limited period or as required by law.

7. Your Rights & Choices

You have the following rights regarding your personal data:

Access: You can export all your data at any time via Settings > Export My Data.
Correction: You can update your profile information at any time through the app.
Deletion: You can permanently delete your account and all associated data via Settings > Delete Account.
Visibility controls: You can hide your profile from the community directory via Settings > Visibility.
Notification preferences: You can control which notifications you receive via Settings > Notifications.
Location: You can enable or disable location sharing through your device settings.
Withdraw consent: You can withdraw consent for data processing at any time by deleting your account.

For EU/EEA Residents (GDPR)

If you are located in the European Union or European Economic Area, you have additional rights under the General Data Protection Regulation (GDPR), including the right to access, rectification, erasure, restriction of processing, data portability, and the right to object. Our legal basis for processing your data is: consent (for location data and notifications), contract performance (to provide the Service), and legitimate interest (for security and fraud prevention). For California Residents (CCPA)

8. Children's Privacy

NOIR is not intended for anyone under the age of 19. We do not knowingly collect personal information from children under 19. If we learn that we have collected information from a child under 19, we will promptly delete it. If you believe a child under 19 has provided us with personal information, please contact us at support@noirmembers.com.

9. International Data Transfers

Your information may be transferred to and processed in countries other than your country of residence. These countries may have data protection laws that are different from your country. We take appropriate safeguards to ensure your information remains protected in accordance with this Privacy Policy.

10. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes through the app or via email. Your continued use of NOIR after changes constitutes acceptance of the updated policy.
